I-78 Reconstruction from MP 35 to MP 44 in Breinigsville, PA
Public Informational Meeting: November 28, 2017
The Krause & Kinsman Law Firm invites property owners and other interested parties to attend a public educational workshop relating to the I-78 Reconstruction from MP 35 to MP 44 on Tuesday, November 28 from 6:30 p.m. to 7:30 p.m. at the Holiday Inn Allentown located at 7736 Adrienne Dr. Breinigsville, PA 18031.
The Pennsylvania Department of Transportation (PennDOT) proposes to rehabilitate eight miles of I-78. A complete reconstruction of the highway pavement is planned, including the addition of truck climbing lanes, widening of shoulders, installation of drainage systems, and replacement/installation of guiderail. In addition, three overhead bridges will be replaced.
Krause & Kinsman attorney Adam Krause will be the featured speaker at this seminar concentrating on landowner rights. Adam will discuss why PennDOT may use the power of eminent domain to acquire private property to complete this road project and will answer land owners’ questions relating to the condemnation process. He will explain some steps property owners can take to safeguard their rights and ensure they receive just compensation the property taken.
Krause & Kinsman attorney Kelvin Morris will also attend the educational seminar. Kelvin will explain the protections established by the 5th Amendment to the United States Constitution, providing that no person shall be deprived of life, liberty, or property, without due process of law and that private property shall not be taken for public use, without the payment of just compensation.
Some questions that may be addressed during the workshop include:
- Can I stop the government from taking my property?
- What if I don’t agree with the fair market value determined by the government’s appointed appraiser?
- Should I discuss the value of my property with a government representative?
- Should I assume the government will treat me justly under eminent domain law?
- Can I negotiate on my own?
- How will the taking impact my home or business?
